LBBA takes the privacy of its users seriously. We are committed to safeguarding the privacy of our users while providing a personalised and valuable service. Any personal information you give to us will be processed in accordance with the UK Data Protection Act 1998.

LBBA will use the information to process your request and to provide any relevant further information (for example key facts and details about studying with us, related educational services, induction days, the application process, fees, accommodation etc.   This Privacy Policy statement explains the data processing practices of LBBA.

Data Protection and Use of Data

DATA PROTECTION ACT 1998 AND GENERAL DATA PROTECTION REGULATION

  1. The Data Protection Act 1998 (DPA) regulates the processing of personal data in any format including both digital and hard copy personal data and all other formats. On 25th May 2018 the General Data Protection Regulation (GDPR), will be introduced which provides individuals with enhanced rights, and imposes increased responsibilities on organisations processing personal data.
  2. This statement establishes LBBA’s procedures on the collection and release of student data and is provided to students at the application stages. It includes information about how student data is used, and where it is supplied by LBBA to the Higher Education Statistics Agency (HESA) and other external parties.
  3. LBBA is the data controller for all personal data that it holds and processes, except where it is done in the capacity of a data processor on behalf of another data controller.

Notification: this entails LBBA informing the Information Commissioner’s Office of certain details about its processing of personal data. Personal data relates to the employees, students and other stakeholders. The registration reference number used is Z3617142

LBBA is therefore obliged to protect the personal data of employees, students and stakeholders in accordance with the Act and its Notification to the Information Commissioner’s Office.

In accordance with the Data Protection Principles personal data of employees, students and stakeholders has to be:

  • Processed fairly and lawfully;
  • Adequate, relevant and not excessive;
  • Held not longer than is necessary;
  • Accurate and up to date
  • Kept securely and
  • Not transferred outside the countries of the European Economic Area without adequate protection

Data security

LBBA and its employees are to ensure that all personal data relating to their employee, students and other stakeholders is securely kept to avoid any unauthorised disclosure.

There should be no accidental disclosure, either orally or in writing, of personal data to any unauthorised third party.

APPLICANTS AND REGISTERED STUDENTS PLEASE NOTE

LBBA may obtain, hold and process the personal data of students including personal details, family and social circumstances, education and training records, employment information, financial details, and services provided. It may obtain, hold and process the sensitive personal data of students including racial or ethnic origin, biometric data, and physical or mental health.

We collect personally identifiable information about you (your “Data”) through:

  • The use of enquiry, application and interview forms
  • Documents provided for your application ( check list is found on our website)
  • Your purchase of any our product or services
  • The provision of your details to us either online or offline

The elements of your Data that we collect may include:

  • Name
  • Photograph
  • Student identification / Passport
  • Next Of Kin
  • Proof of being in the UK
  • Bank statements
  • Home address and phone
  • Mobile telephone number
  • E-mail address
  • Date of birth
  • Additional information ( special needs)
  • Educational history, work experience and other information from your CV if you provide this to us
  • Overseas Home address if applicable, Date of Birth

Personal data and sensitive personal data held relating students is obtained directly from the student or applicant, or in some cases from a third party organisation for example from agents involved in student recruitment. LBBA holds the personal data and sensitive personal data of its students in order to implement and manage all services and processes relating to students, including student recruitment, admission, registration, teaching and learning, assessments, and other services such as student support and careers. Only information required for these purposes is obtained and processed, and without it LBBA may not be able to provide its services. Student personal data is collected and processed and is necessary for the services which LBBA provides to students.

Some processing activities may be carried out under a legal obligation (for example, disclosing personal data to external parties under statutory powers. Where students’ sensitive personal data is collected and processed this will be on the legal basis of consent of the student, protecting the vital interests of the student or another party, the exercise or defence of a legal claim, reasons of substantial public interest, purposes of medical or health care, Any processing will be proportionate and relate to the provision of services by LBBA. When this data is used for monitoring and reporting purposes it will be anonymized if possible.

LBBA may disclose student’s personal data and sensitive personal data to external agencies to which it has obligations; for example for council tax and visa and immigration purposes, central or local government, to the Office Of Students , Higher Education Statistics Agency, Student Loans Company, Office of the Independent Adjudicator for Higher Education and potentially other such organisations for defined purposes. It may also disclose information to examining bodies, legal representatives, Police or security agencies, suppliers or service providers, survey and research organisations engaged by LBBA and regulatory authorities. If students have unpaid debts to LBBA at the end of their course , at its discretion we may pass this information to debt collecting agencies in order to pursue the debt.

The LBBA also uses student’s personal data as follows:

  • Provide progress reports to sponsors of students
  • Processing applications, registrations and enquiries
  • Maintaining your student record ( including personal and academic)
  • Managing the academic processes ( including teaching, Assessment Board meetings, providing support)
  • For the purposes of plagiarism detection, utilising the on-line Turnitin plagiarism detection service.
  • Produce educational certificates, end of course summaries,
  • To identify courses and future products for LBBA
  • Attendance purposes

LBBA requires all students to participate in its attendance monitoring system and there may be a requirement to report non-attendance to official bodies (e.g. UK Visas and Immigration and other relevant authorities).

All requests will be dealt within 30 Working Calendar Days, you will be kept informed during the process. You need to provide enough information when you write in and be clearly identifiable (for example full name, Date Of Birth) submitted together with proof of identity (for example, a copy of a passport).

Individuals whose personal data and sensitive personal data is held by LBBA have the following rights regarding their data: Please state therefore what you are requesting for:

  1. The right to request access to their personal data held
  2. The right to have inaccurate or incomplete personal data rectified.
  3. The right to erasure of personal data – this will only apply where there is no legitimate reason for LBBA to continue to process the personal data.
  4. The right to object – students can object to the processing of their personal data by LBBA in certain circumstances, including the sending and receipt of direct marketing material from LBBA
  5. The right to collect  data and copies of documents left to process your student application. This can easily be collected from LBBA provided the application has not been processed  and it is prior to registration with the Awarding body.

Note well : LBBA may not be able to perform its obligations for the Services contracted and some of the consequences of doing so could be that:

  • We will not be able to provide all or parts of the Services you have requested from us.
  • We will need to inform the relevant authorities that you have made this request so they are aware.
  • You will not be able to cancel your course or obtain a refund of any charges you have paid.
  • We will be unable to update you on any changes , policies, alerts from LBBA, promotions and other news;
  • We will be unable to provide you with the best learner experience, or with support needed for the course.
  • We will generally be unable to provide you with the best customer experience we would like to provide you with

STUDENT FEEDBACK AND STUDENT SURVEYS ON COMPLETION OF YOUR STUDIES

LBBA during your course on regular basis will ask you for both written and verbal feedback and this information will be collected and processed to ensure we can make necessary improvements. Your contact details may be passed to student surveys needed such as the National Student Survey (NSS) Approximately six months after course completion LBBA may contact you to ask you to fill in the HESA ‘Destinations of Leavers from Higher Education’ survey.

SUBMISSION OF YOUR INFORMATION TO HESA

It is a statutory requirement for LBBA to send some of the information we hold about you to HESA every year (“your HESA information”). All uses of HESA information must comply with the Data Protection Act 1998 and the General Data Protection Regulation.
